1. DEFINITIONS & INTERPRETATION:

2. PAYMENT POLICY:

• Any person paying online should use their own personal credit or debit cards & Crypto wallet. If not, then the service may not be rewarded.
• The first payment shall be made on the commencement date of the first rental interval period, and thereafter the first date of each subsequent rental intervals.
• If Renter fails to make a payment on the due date, Rental shall have five (5) days grace period to make the payments.
• Renter shall pay a delayed penalty charges of 250 AED + 5% VAT for Economy Cars & 500 AED + 5% VAT for Luxury Cars to ADS Car Rental if Renter fails to make the payment within the grace period
• ADS Car Rental shall send an invoice to Renter each month for any charges incurred under rental agreement e.g (Fines, Impounding charges, Blackpoint, Restriction charges. Renter must settle this invoice within three (3) days of receiving the relevant.
• Renter confirms that ADS Car Rental is authorized to charge all the cost, as set out in this agreement, from Renter’s Credit card without prior Renter’s approval/Authorization.

3. INVOICING AND PAYMENT TERMS:

• You will only pay when you pick up your car. However, in the event that you are specific about the car you will require let your sales agent know. In these cases, we will charge the security deposit in advance in order to ensure the booking of the requested car.
• Our invoice will be issued on the day you pick your car, in advance of the term of the rental (i.e. a prepayment) and must be settled in full immediately.
• We will charge a deposit of 1,500 AED(For Economy) to 10,000 AED(For Luxury) which will be refundable, upon return of the car (“Vehicle Check-In”). This amount will be refunded after 30 working days from the date of return of car to take care of any traffic fines, Salik (toll charges), Early Termination, damage etc. This will be the charged amount. All the charges and traffic fines need to be settled immediately.
• Payments can be made by cheque, bank transfer, corporate credit card or any other method mutually agreed between you company, in writing. All customers are required to always maintain a valid credit card on file at all time, failure of which in the termination of the contract.
• All rental periods are calculated on a 24-hour basis for Economy vehicle & Hourly basis for Luxury vehicle. For example, a starting at 9 a.m must be returned 9a.m the following day. Any delay will result in an extra day being charged.
• Vehicle rented on a weekly contract which are returned during the first week of the rental will be charged based on the Daily rate. Similarly, Vehicle rented on monthly basis which are returned during the first month of the rental will be charged on the weekly rate. For an immediate early contract termination without any advance notice a one-day rental charges will apply.

4.FUEL POLICY:

• Hirer must return the vehicle with the same fuel level as given by ADS Car Rental. ADS Car Rental is authorized to charge the cost of fuel plus a service charge to the Renter’s accounts if fuel is less than the initial level. Extra fuel is not refundable either in cash or fuel.

5.SERVICE & MAINTANENCE POLICY:

• ADS Car Rental provides full maintenance, repairs and servicing of the vehicle in accordance with schedule
• Hirer must bring the vehicle for service at regular kilometer intervals as mentioned on the service sticker or scan through the sticker to inform the company, any damage occurs to the vehicle for not servicing regularly will be charged to the Hirer upon the estimation from the agency.
• Tyres shall only be replaced at every 50,000 kilometers as a result of normal wear and tear and any damages resulting due to puncture or tyre damage will be charged to the Hirer.
• Renter should not under any circumstance repair, remove or replace any part, accessory or equipment of the vehicle nor change the colour or allow any modification, alteration or repair to be made to the vehicle.
• For Luxury vehicle if any mechanical repairs happens due to customer negligence or fault, and the same not informed to ADS Car Rental prior, then after inspection if we found its customer fault then Renter will bear all the repair and the number of days vehicle in the workshop rental days will be charged to the Renter’s account.

6.REPLACEMENT TERMS:

• During the circumstance of Fault/Accident/Maintenance and the same take more than 4 hours to repair, a suitable/equivalent grade vehicle will be provided as Replacement which will have same rental charges as the original hired vehicle.
• No replacement vehicle shall be provided if the repair and maintenance is required due to Renter’s negligence.
• Cost of fuel used while driving the replacement vehicle will be charged to the Renter if its not returned at the same level.
• Replacement is always at the sole discretion of ADS Car Rental. Replacement will not be provided for any impounding case and wherever the impounding of vehicle becomes statutory requirement then rental charges for the impounding period will be recovered from the Renter.

7.DRIVERS AND LICENSING REQUIREMENTS:

• All drivers must be over 21 years old and 25 yearsold for Luxury sports cars. Drivers must provide a valid international or national (local)license, some local licenses are not accepted, our sales team will check your license validity before renting you the car.
• Drivers must not be under the influence of alcohol or drugs while operating the vehicle. All insurance claims resulting from Driving under the influence will be denied and the Renter will be responsible for all resulting damage repairs.
• It is primarily your responsibility to ensure that you are eligible to drive a rent a car in compliance with the laws of the UAE. It is prohibited to pass the vehicle to any third party or individual who is not listed in the rental agreement.

8.RESTRICTION:

• Smoking in our vehicles is strictly prohibited as it damages our vehicles and is a safety hazard while driving. Smoking in our vehicle may result in a penalty of up to AED 2,000 + 5% VAT depending upon the vehicle.
• Not conduct any illegal activities using the vehicle at any time.
• Not drive the vehicle outside the UAE and in the geographical territories of Oman without getting prior approval from ADS Car Rental
• Hirer must return the car in the same condition he received it, if the car is dirty or has any food leftovers or stains, this will result in a charge
• Offroading, rallying, reckless driving, racing or ‘drifting’ in our vehicle is strictly prohibited. Going to deserts, and tracks is not allowed. Apart from the government charges it results in a penalty of up to AED 100,000 + 5% VAT paid to ADS Car Rental.
• Customer is not allowed to drive over 160km/hr, if the driver goes over this speed limit, he will be warned on the 1st attempt, and charged a penalty of 20,000AED +5% VAT on the 2nd attempt, and on the 3rd attempt we will shut down the car, and the remaining period will not be refunded. Pets are not allowed in our vehicles.

8.KEY LOST CHARGES:

• If the key missing is reported by the Hirer, the Hirer will be provided with the spare key for 24 hours with the delivery & conveniences charges.
• f within 24 hours the spare key not returned to office, then it will be considered as original key lost, and Renter has to pay new key charges with key programming cost.
• For Economy cars: Penalty charges upto 3000 AED + 5% VAT.
• For Luxury cars : Penalty charges upto 75,000AED + 5% VAT.

10.MILEAGE USAGE:

• Allowed mileage is limited as per the contract, typically 250KM per day,1500KM per week or 3000KM per month. Extra usage will be charged at the rate of (1AED-100AED + 5% VAT) per KM, depending on the car (Luxury / Economy).

11.SALIK (TOLL CHARGES) & TRAFFIC FINE:

• The Salik (toll) charged will be the toll amount (typically AED 4), plus an AED 0.76 service fee plus VAT on the both component.(e,g 5 AED for each salik crossing).
• All traffic fine charges will be actual fine, plus up to (AED 100 or 10%) service fee whichever is higher will be Charged plus 5% VAT on the service fee component. We will inform you as soon as we get a notification from the concerned authorities.

12.IMPOUNDING & BLACK POINTS:

• If the fine caused the car to be impounded, a penalty ranging from 100AED-500AED + 5% VAT will be charged per day depending upon the vehicle. You will be required to pay these amounts immediately upon notification.
• If any non-payable fine imposed on the rental vehicle then the black points along with fine will be transferred to the authorised driver in the rental agreement. This transferring of black points includes the customer who have international license.
• All Impounding and black points must be cleared immediately by Renter upon notification from ADS Car Rental

13.INSURANCE TERMS:

• All our vehicle are comprehensively insured-driver, passenger and third-party liability is provided. It is your responsibility to ensure that you conduct a thorough inspection of the vehicle prior to check-out and to ensure that all pre-existing damages are recorded on the vehicle check report (VCR).
• To pay the excess insurance amount (1,500 AED to 20,000 AED) plus 20% +VAT (amount vary depending upon the car) of the repair within agency if not opted for CDW as mentioned in the contract in case of an accident where the Hirer is at & run scenario and in addition to the daily rental charges for the number of days the vehicle stays repair in the agency.
• All insurance and damage claims will require a valid police report in order to be processed. Damage caused to our vehicles which third party is not identified, for which a police report has not been produced or which results in the insurance claims being denied will be charged in accordance with ADS Car Rental Damage Rate
• Repairs done by third-party garages and mechanics and not done by ADS Car Rental will not be acceptable.
• Note that tires, wheel, & rims damages are not included into the insurance coverage and the Renter is responsible for the cost of repair or replacement.
• If the Renter not opted for any CDW/SCDW in case of accident occurred where the Hirer is non-faulty he or she will be bearing the charges for the number of days the vehicle will be in workshop for repairs based on the agreement pro-data basis.
• In case of occurrence of a total loss accident with the vehicle (Total Loss) the Renter has to paid the fixed insurance excess charges which is mentioned on the agreement clause if he opted for CDW and if he don’t opted for CDW then Renter has to pay fixed excess charges along with 30% of car insured value need to be paid to ADS Car Rental.
• For Hirers below 25 years age for any insurance type an additional 10% repair cost + 5% VAT to be paid in any case of accident.

14.EARLY TERMINATION CHARGES:

• For Long term (12 Months) contract, a penalty equivalent to (1) month rental rate will be imposed to Hirer, similarly for every month’s annual agreement sub-sequent monthly rate will be charged to Hirer plus 5 % VAT on the termination charges has paid to ADS Car Rental. (e.g 3 month’s penalty for 3-year agreement).
• For 6 Months contract, if Hirer terminates the contract before the due date, then He or She must pay 15 days rental amount as termination charges plus 5 % VAT on the termination charges has to be paid to ADS Car Rental.
• For Monthly contract, if Hirer terminates the contract before the due date, then He or She must pay 3 days rental amount as charges plus 5 % VAT on the termination charges has to be paid to ADS Car Rental.

15.FORCE MAJEURE:

• ADS Car Rental shall not liable for any delays or failure to perform its obligations due to cause beyond its reasonable control, including fire, flood, earthquake, elements of nature, riots, civil orders or third parties (Force Majeure Event).For the duration of the Force Majeure event.
• ADS Car Rental obligations shall be suspended, provided that ADS Car Rental uses all reasonable endeavours to continue to perform or to resume the performance of its obligations during the force majeure event

16.WATER DAMAGE:

• Claims will be dealt with as per regulatory insurance policy, Renter agrees to take the necessary precautions and avoid driving the vehicle into Water or flooded areas. Renter may be liable for cost of damage and/or vehicle, should the insurance provider rejects claims. If the vehicle has been exposed to water/flood, Renter should not start the engine and inform ADS Car Rental immediately for necessary assistance.
• For any flooded vehicle if the Renter not informed prior to ADS Car Rental and deny the misuses of vehicle then In such case all the repair cost will be recovered from the Renter’s account. In addition to that number of days vehicle in the workshop rental days will be charged to the Renter’s account.

17.GENERAL TERMS:

• A company policy, all terms, conditions and agreements between you, ADS Car Rental and our sales associates are required to be recorded in writing before being enacted.
• ADS Car Rental has all the rights to “SWITCH OFF” the vehicle incase of non-payment and collect the vehicle through FORCE COLLECTIONprocess.
• All rental and lease agreements will be governed by the applicable laws of the United Arab Emirates. All applicable current and future government taxes and levies will be imposed as required the laws of the UAE.
• In case of accident (even if the accident wasn’t caused by the customer), the contract will be automatically terminated. No refund or replacement will be made. A police report must be provided in case of any accident or scratches (even if the accident wasn’t caused by the customer). This applies to customer who also paid for full insurance.
• IIn case of any misuse of the car (Drifting, standing on the roof, Burnouts, etc…) the contract will be automatically terminated.
• ADS Car Rental has the right to arrange for the subsequent transfer of the Personal Data to a collection agent, either directly or via the Partner, in case the Customer does not make the payments due under the Rental Agreement.
• If the Hirer is refusing to pay for the rent, extra kms, damages, fines or any other fees related to the rented vehicles, the rental agreement will be kept open until the customer will pay the outstanding balance and handover the car to the ADS Car Rental employee. Extra rental days will be charged until the full payment was honoured by the Hirer.
• The Hirer agrees that if he/she fails to pay any additional expenses arising as the result of the Hirer's use of the car as per the Rental Agreement, the Hirer shall pay a fine for the outstanding debt amounting (i)up to 20% if the debt is not paid in total between the 10th to 20th from the invoice date.

18.GOVERNING LAW AND JURISDICTION:

• This document shall be governed by and interpreted under the laws of the Emirates of Dubai and applicable federal laws of UAE, and the parties shall submit to the exclusive jurisdiction of the courts of Dubai.
