1. DEFINITIONS & INTERPRETATION:

ADS Car Rental/We

Refers to either (i) ADS Rent A Car LLC, a company duly registered in the UAE, or (ii) Enjoy Car Rental LLC, a company duly registered in the UAE, depending on which entity the Hirer enters into a car rental agreement with.

Renter/Hirer

Refers to the natural person or entity who has agreed to rent the vehicle as mentioned in this document, according to the terms set forth herein, and holds sole responsibility for clearing payments.

Additional Driver

Refers to the natural person authorized to drive the vehicle during the rental period.

Laws

Refers to compliance with all rules and regulations of the UAE.

2. PAYMENT POLICY:

• Any person making a payment online should use their own personal credit or debit cards or crypto wallet. If not, the service may not be provided.
• The first payment is due on the commencement date of the first rental period, and subsequent payments are due on the first date of each subsequent rental period.
• If the Renter fails to make a payment by the due date, there will be a five (5) day grace period to make the payment.
• If the Renter fails to make the payment within the grace period, a late fee will be charged:250 AED + 5% VAT for Economy Cars & 500 AED + 5% VAT for Luxury Cars
• ADS Car Rental will send an invoice to the Renter each month for any additional charges incurred under the rental agreement (e.g., fines, impounding charges, black points, restriction charges). The Renter must settle this invoice within three (3) days of receiving it.
• The Renter confirms that ADS Car Rental is authorized to charge all costs, as set out in this agreement, to the Renter’s credit card without prior approval or authorization from the Renter.

3. INVOICING AND PAYMENT TERMS:

Payment upon Pickup.

Payment is required when you pick up your car. If you have a specific vehicle in mind, please inform your sales agent. In such cases, a security deposit will be charged in advance to secure the booking of the requested car.

Invoice and Prepayment

An invoice will be issued on the day you pick up your car, covering the rental term as a prepayment. This invoice must be settled in full immediately.

Security Deposit

A refundable deposit of 1,500 AED (for Economy) to 10,000 AED (for Luxury) will be charged. This deposit will be refunded after 30 working days from the car's return, subject to deductions for any traffic fines, Salik (toll charges), early termination fees, or damage. All charges and fines must be settled immediately.

Payment Methods

Payments can be made by cheque, bank transfer, corporate credit card, or any other mutually agreed method. All customers must maintain a valid credit card on file at all times. Failure to do so may result in contract termination.

Rental Period Calculation

Rental periods are calculated on a 24-hour basis for Economy vehicles and on an hourly basis for Luxury vehicles. For example, a vehicle picked up at 9 a.m. must be returned by 9 a.m. the following day. Any delay will result in an extra day’s charge.

Early Termination

Vehicles rented on a weekly contract and returned within the first week will be charged based on the daily rate. Similarly, vehicles rented on a monthly basis and returned within the first month will be charged on a weekly rate. Immediate early termination without prior notice will incur a one-day rental charge.

4.FUEL POLICY:

Fuel Level Requirement

The Hirer must return the vehicle with the same fuel level as when it was provided by ADS Car Rental.

Charges for Fuel

If the vehicle is returned with less fuel than initially provided, ADS Car Rental is authorized to charge the cost of the missing fuel plus a service fee to the Renter's account.

Non-Refundable Fuel

Any extra fuel left in the vehicle at the time of return is non-refundable, whether in cash or fuel.

5.SERVICE & MAINTANENCE POLICY:

Regular Maintenance

ADS Car Rental provides full maintenance, repairs, and servicing of the vehicle according to the scheduled intervals.

Service Intervals

The Hirer must bring the vehicle in for service at regular kilometer intervals as indicated on the service sticker or scanned through the sticker to notify the company. Any damage resulting from failure to adhere to the service schedule will be charged to the Hirer based on the agency’s assessment.

Tyre Replacement

Tyres will be replaced at every 50,000 kilometers due to normal wear and tear. Any damage resulting from punctures or other tyre issues will be charged to the Hirer.

Prohibited Modifications

The Renter must not, under any circumstances, repair, remove, replace, or modify any part, accessory, or equipment of the vehicle, nor change its color.

Luxury Vehicle Repairs

For luxury vehicles, if mechanical repairs are required due to customer negligence or fault and are not reported to ADS Car Rental beforehand, the Renter will be responsible for all repair costs. Additionally, if the vehicle is in the workshop due to customer fault, the rental charges for the days the vehicle is under repair will be billed to the Renter.

6.REPLACEMENT TERMS:

Replacement Vehicle

If the vehicle requires repair due to a fault, accident, or maintenance issue and the repair time exceeds 4 hours, a suitable or equivalent replacement vehicle will be provided. The rental charges for the replacement vehicle will be the same as those for the original hired vehicle.

Exclusions

No replacement vehicle will be provided if the repair or maintenance is due to the Renter’s negligence.

Fuel Charges

The cost of fuel used in the replacement vehicle will be charged to the Renter if the vehicle is not returned with the same fuel level as initially provided.

Discretion and Impoundment

Replacement vehicles are provided at the sole discretion of ADS Car Rental. Replacement vehicles will not be provided in cases of impounding or where impoundment is a statutory requirement. In such cases, rental charges for the period the vehicle is impounded will be recovered from the Renter.

7.DRIVERS AND LICENSING REQUIREMENTS:

• All drivers must be over 21 years old and 25 yearsold for Luxury sports cars. Drivers must provide a valid international or national (local)license, some local licenses are not accepted, our sales team will check your license validity before renting you the car.
• Drivers must not be under the influence of alcohol or drugs while operating the vehicle. All insurance claims resulting from Driving under the influence will be denied and the Renter will be responsible for all resulting damage repairs.
• It is primarily your responsibility to ensure that you are eligible to drive a rent a car in compliance with the laws of the UAE. It is prohibited to pass the vehicle to any third party or individual who is not listed in the rental agreement.

8.RESTRICTION:

Smoking

Smoking in our vehicles is strictly prohibited due to potential damage and safety hazards. Violation of this policy may result in a penalty of up to AED 2,000 + 5% VAT, depending on the vehicle.

Illegal Activities

The vehicle must not be used for any illegal activities at any time.

Geographical Restrictions

The vehicle must not be driven outside the UAE or into the geographical territories of Oman without prior approval from ADS Car Rental.

Vehicle Condition

The vehicle must be returned in the same condition it was received. Any dirt, food leftovers, or stains will result in an additional charge.

Prohibited Activities

Off-roading, rallying, reckless driving, racing, or 'drifting' are strictly prohibited. Driving on deserts or tracks is not allowed. Violations of these restrictions may result in a penalty of up to AED 100,000 + 5% VAT, in addition to any government charges.

Speed Limit

The vehicle must not be driven over 160 km/h. If this speed limit is exceeded:

• On the first occurrence, the driver will receive a warning.
• On the second occurrence, a penalty of AED 20,000 + 5% VAT will be charged.
• On the third occurrence, the vehicle will be shut down, and the remaining rental period will not be refunded.

Pets

Pets are not allowed in our vehicles.

8.KEY LOST CHARGES:

• If the key is reported missing by the Hirer, a spare key will be provided for 24 hours, including delivery and convenience charges.
• If the spare key is not returned within 24 hours, it will be considered as the original key being lost. In this case, the Hirer will be responsible for paying the cost of a new key and key programming.

• Charges:

  • For Economy Cars. Penalty charges up to AED 3,000 + 5% VAT.
  • For Luxury Cars. Penalty charges up to AED 75,000 + 5% VAT.

10.MILEAGE USAGE:

• Mileage Limits. The allowed mileage is as per the contract, typically:
  • 250 KM per day
  • 1,500 KM per week
  • 3,000 KM per month
• Additional Charges. Any mileage exceeding the allowed limit will incur a charge based on the car type:
  • Economy Cars: AED 1 to AED 100 + 5% VAT per extra KM
  • Luxury Cars: AED 1 to AED 100 + 5% VAT per extra KM

11.SALIK (TOLL CHARGES) & TRAFFIC FINE:

• Salik Charges: The toll charge will be the Salik amount (typically AED 4) plus an AED 0.76 service fee. VAT will be applied to both components. For example, each Salik crossing will total approximately AED 5.
• Traffic Fines. Traffic fines will be billed as follows:
  • The actual fine amount
  • A service fee of up to AED 100 or 10% of the fine, whichever is higher, plus 5% VAT on the service fee

We will notify you as soon as we receive information from the relevant authorities.

12.IMPOUNDING & BLACK POINTS:

• If the vehicle is impounded due to a fine, a penalty will be charged ranging from AED 100 to AED 500 per day, depending on the vehicle. This amount, plus 5% VAT, must be paid immediately upon notification.
• If a non-payable fine results in black points being imposed on the vehicle, these black points, along with the fine, will be transferred to the authorized driver listed in the rental agreement. This includes customers with an international license.
• All impounding charges and black points must be settled immediately by the Renter upon notification from ADS Car Rental.

13.INSURANCE TERMS:

• All our vehicles are comprehensively insured, including coverage for the driver, passengers, and third-party liability. It is the Hirer’s responsibility to conduct a thorough inspection of the vehicle prior to checkout and ensure that all pre-existing damages are recorded on the Vehicle Check Report (VCR).
• In the event of an accident, if Collision Damage Waiver (CDW) is not opted for as stated in the contract, the Hirer will be responsible for paying the excess insurance amount (ranging from AED 1,500 to AED 20,000) plus 20% VAT (amount varies depending on the car). Additionally, daily rental charges will apply for the duration the vehicle is under repair at the agency.
• All insurance and damage claims require a valid police report to be processed. Damage to vehicles where the third party is not identified, no police report is produced, or where insurance claims are denied will be charged according to the ADS Car Rental Damage Rate. Repairs done by third-party garages and mechanics are not accepted.
• Tires, wheels, and rims are not covered under insurance. The Hirer is responsible for the cost of repair or replacement of these components.
• If the Hirer has not opted for CDW/Super Collision Damage Waiver (SCDW) and an accident occurs where the Hirer is not at fault, the Hirer will bear the charges for the number of days the vehicle is in the workshop for repairs on a pro-rata basis.
• In the case of a total loss accident, if CDW is opted for, the Hirer will pay the fixed insurance excess charges specified in the agreement. If CDW is not opted for, the Hirer must pay the fixed excess charges plus 30% of the vehicle’s insured value.
• For Hirers under 25 years of age, an additional 10% of the repair cost plus 5% VAT will be applied in the case of an accident, regardless of the insurance type.

14.EARLY TERMINATION CHARGES:

• If the Hirer terminates a long-term contract (12 months or more) early, a penalty equivalent to one month’s rental rate will be imposed. For each additional month in the annual agreement, the Hirer will be charged the subsequent monthly rate plus 5% VAT on the termination charges. Example: For a 3-year agreement, if terminated early, the penalty will be equivalent to three months’ rental rate.
• If the Hirer terminates a 6-month contract before the end date, they must pay an amount equivalent to 15 days of rental plus 5% VAT on the termination charges.
• If the Hirer terminates a monthly contract before the end date, they must pay an amount equivalent to 3 days of rental plus 5% VAT on the termination charges.

15.FORCE MAJEURE:

ADS Car Rental shall not be liable for any delays or failure to perform its obligations due to causes beyond its reasonable control, including but not limited to fire, flood, earthquake, natural disasters, riots, civil disturbances, or actions by third parties (collectively, "Force Majeure Events").

During the period of a Force Majeure Event, ADS Car Rental’s obligations under the contract shall be suspended. ADS Car Rental will use all reasonable efforts to continue to perform or to resume performance of its obligations as soon as reasonably possible after the Force Majeure Event has ended.

16.WATER DAMAGE:

Claims related to water damage will be handled according to the regulatory insurance policy. The Renter agrees to take all necessary precautions to avoid driving the vehicle into water or flooded areas. If the insurance provider rejects the claim, the Renter may be liable for the cost of damage to the vehicle.

If the vehicle has been exposed to water or flooding, the Renter should not start the engine and must inform ADS Car Rental immediately to receive necessary assistance. Failure to notify ADS Car Rental prior to any misuse or water exposure will result in the Renter being responsible for all repair costs. Additionally, the Renter will be charged for the number of days the vehicle is in the workshop for repairs, as well as any rental days associated with the repair period.

17.GENERAL TERMS:

• 1. All terms, conditions, and agreements between you, ADS Car Rental, and our sales associates must be recorded in writing before being enacted.
• 2. ADS Car Rental reserves the right to deactivate the vehicle in case of non-payment and to collect the vehicle through a forced collection process.
• 3. All rental and lease agreements will be governed by the applicable laws of the United Arab Emirates. All applicable current and future government taxes and levies will be imposed as required by UAE law.
• 4. In the event of an accident (regardless of fault), the contract will be automatically terminated. No refund or replacement will be provided. A police report must be provided for any accident or scratches, even if the accident was not caused by the customer. This applies to customers who have paid for full insurance.
• 5. Any misuse of the vehicle (e.g., drifting, standing on the roof, burnouts) will result in automatic termination of the contract.
• 6. ADS Car Rental has the right to transfer personal data to a collection agent, either directly or via a partner, if the customer fails to make payments due under the rental
• 7. If the Hirer refuses to pay for rent, extra kilometers, damages, fines, or any other fees related to the rented vehicle, the rental agreement will remain open until the outstanding balance is paid and the vehicle is returned to an ADS Car Rental employee. Extra rental days will be charged until the full payment is made.
• 8. If the Hirer fails to pay any additional expenses arising from the use of the car as per the rental agreement, a fine of up to 20% of the outstanding debt will be applied if the debt is not paid in full between the 10th and 20th day from the invoice date.

18.GOVERNING LAW AND JURISDICTION:

• This document shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. The parties agree to submit to the exclusive jurisdiction of the courts of Dubai.
